Introduction

Development Promotions Proprietary Limited (registration number 1972/007735/07) is a wholly owned South African business that has been operating for over 50 years.  The longevity of the years promoting and marketing some of the most prestigious international and domestic travel products, via representation agreements with Suppliers, may be attributed to the four-decade tenure of two of the three directors within the business and a deeply entrenched career of the same period within the travel industry for the third director.  A longtime member of the Association of South African Travel Agents (ASATA), Board of Airline Representatives South Africa (BARSA) and the American Chamber of Commerce (AMCHAM) Development Promotions abides by the body’s Constitution and Code of Conduct.

Everything Cruising (a division of Development Promotions Proprietary Limited) is an intermediary of travel arrangements. It neither owns or operates any modes of waterborne transport, air transport, ground transport, rail, hotels, organised tours, wholesale tour operators and other suppliers of services.

Everything Cruising conducts business at 23 Eaton Road, North Block, Ground Floor, Bryanston, Gauteng, South Africa. By using the Everything Cruising website, you agree to the Terms and Conditions set out in this document.

All services rendered by or on behalf of the Customer are subject to the Terms and Conditions, and limitations of liability imposed by those operators of waterborne transport, air transport, ground transport, rail, hotels, organised tours and wholesale tour operators, and other service providers whose services are utilised herein referred to as the “Supplier”.

Terms & Conditions

The following Terms and Conditions should be read and understood before confirming your booking. By proceeding to book you acknowledge that you have read, understood, and tacitly accept the Terms and Conditions. You have the authority to do so on behalf of the person/s in whose name/s the ultimate reservation/s or booking/s are made and/or provided and/or the person/s to whom the services are rendered (collectively referred to as “Customer(s)”), notwithstanding the Customer(s) failure to sign these Terms and Conditions.

By using the Everything Cruising website or contacting a Live Agent of Everything Cruising directly, it is the Customer and accompanying passengers’ responsibility to familiarise themselves with all terms and conditions that apply to their booking, and they subsequently agree to the Terms and Conditions set out in this document.

We may, at any time, and at our sole discretion, modify these Terms and Conditions, with or without notice to the Customer.  Any such notification will be effective immediately upon public posting on our website.

All travel arrangements made on behalf of the Customer are subject to Terms and Conditions, and limitations of liability imposed by third-party suppliers, and service providers whose Services are utilised.  It is the responsibility of the Customer to ensure that they have familiarized themselves with all Terms and Conditions that apply to their itinerary.

  1. Services
    1. Everything Cruising hosts a website that advertises via social media with a primary focus on displaying cruise and leisure products to that consumer who may be soliciting such travel options.
    2. We do not own, manage, control, or operate any vehicle on land or water, any accommodation property, any type of restaurant, or any other supplier of services. Our role is limited to facilitating the booking process and we are not responsible for the quality or safety of the services provided by these third-party suppliers.
    3. Everything Cruising acts as a facilitator in the making of all arrangements for transportation, sightseeing, and hotel accommodation. Everything Cruising does not own, manage, control, or operate any vehicle, any hotel any restaurant, or any other supplier of services.
    4. Everything Cruising reserves the right to modify or discontinue any aspect of our Services at any time without prior notice.
  2. Booking
    1. Once the Customer has:
  • completed all applicable forms to initiate an Enquiry regarding a particular destination, trip, cruise, tour, mode of travel, preferred accommodation and/or another service on Everything Cruising’s website everythingcruising.co.za, or
  • initiated such an enquiry with Everything Cruising by any other means of communication including by means of a travel company, or telephonically or in-person (collectively referred to as ‘the Enquiry’), Everything Cruising will prepare and provide the Customer with a projected total cost of the Enquiry (online, by e-mail, by SMS or telephonically)

(‘the Quote’).

  1. The Quote is accepted by the Customer when the Customer proceeds with the steps as specified on the Sites or accepts the Quote telephonically or via email. Full payment of the total value of the Quote (‘the Payment’) is required to confirm reservations with the relevant Principals (‘the Booking’). Once the Booking affected by Everything Cruising has been completed and the Customer has authorised Everything Cruising to process the Payment, the Customer will be supplied with an email that will contain the final details of the Booking (“the Booking Confirmation Form”).
  1. Pricing
    1. Any price displayed on the website remains estimated until the final payment is received, and a confirmation is received. If the Customer does not book and pay, the displayed fare is not guaranteed and can change at any time.
    2. Prices are quoted in either ZAR (South African Rand) or the currency applied by the International Supplier. ZAR prices for Payment are calculated by using a Rate of Exchange determined by Everything Cruising based on prevailing exchange rates available from commercial banks.
    3. ZAR prices confirmed on day of Payment will be valid if Payment is received the same day – thereafter prices are subject to revision in accordance with prevailing Everything Cruising exchange rates and fluctuation in airfares, government and other taxes and fuel surcharges and any other conditions outside the control of Everything Cruising.
    4. For Credit Card payments processed directly to International and/or Regional Suppliers, the Rate of Exchange is determined by the Customers Credit Card Company. This facility is available for select Suppliers only.
    5. Deposits paid will secure bookings, but the final payment amount will be subject to the Rate of Exchange on the day of payment.
    6. All prices quoted or advertised are based on prices and exchange rates prevailing at the time of posting.
    7. All information quoted or advertised is checked to the best of our ability and is correct at the time of posting.
    8. Quotes may be based on dynamic pricing where itineraries have been created by combining various travel components such as flights, cruise booking, rail, accommodation, car rental, and activities in real-time and are subject to availability.
    9. Prices and availability are not guaranteed until a provisional reservation is held.
    10. Bookings paid in full are not subject to Price changes that are affected by rate of exchange fluctuations.
    11. Everything Cruising is not responsible for any changes, which may occur after the publication of our Supplier’s rates in their brochure or on websites.
  2. Reservation/booking
    1. A Booking Confirmation form is necessary to secure the travel plans which are based on the details provided. The Customer must fully complete, sign, and return the Booking Confirmation form to Everything Cruising. 
    2. It is important to carefully read and understand both sets of terms and conditions before signing the Booking Confirmation form. By signing the booking form, the customer confirms that the information is accurate and that they agree to the Terms and Conditions of both Everything Cruising as well as the Terms and Conditions of the relevant Supplier.
    3. The Booking will be confirmed upon receipt of a deposit or full payment.
    4. It is the Customer’s responsibility to ensure that their first name and surname are spelled correctly at the time of Booking as they appear in their identity document or passport before they book and pay for the package.
    5. The Customer must check the personal and booking details on the Everything Cruising Booking Confirmation and the Invoice to ensure that all the details match the passenger’s passports and are exactly as you requested.
    6. By making a Booking with Everything Cruising, the Customer acknowledges and agrees that we are acting solely as an agent for the third-party service provider who is responsible for delivering the travel or service that you have booked. Everything Cruising does not own, manage, control, or operate any vehicle on land or water, any accommodation property, any type of restaurant, or any other supplier of services.  Our role is limited to facilitating the Booking process and we are not responsible for the quality or safety of the Services provided by third-party suppliers.
    7. The Customer also consents to have his/her contact information shared with the third-party supplier to facilitate the reservation.
  3. Payment
    1. To secure the Booking, a deposit is required at the time of the booking per the Booking Confirmation of arrangements issued by Everything Cruising.
    2. If the deposit is not received by the due date, Everything Cruising, reserves the right to consider your Booking canceled and to apply the appropriate cancellation charges where applicable.
    3. It is important to check the Booking Confirmation and the invoice to ensure that all the details are exactly as you requested.
    4. All rates quoted in foreign currency are subject to the relevant exchange rate on the day of payment.
    5. All Booking Confirmations must be prepaid before the final payment due date under Supplier Terms and Conditions.
    6. Failure to remit final Payment on the due date will result in cancellation of the Booking, and forfeiture of deposit and may attract cancellation costs.
    7. Until full Payment is received, your entire Booking is subject to currency fluctuation.
    8. Bookings made close to the departure date will require full payment before Everything Cruising request the services. In this case, payment does not guarantee that a booking is confirmed unless or until otherwise stated.
    9. Should the services not be confirmed, Everything Cruising will refund all the money paid.
    10. Once services are confirmed, cancellation penalties will apply under the Supplier Terms and Conditions.
    11. By providing your Credit Card information the Customer authorises Everything Cruising to charge the specified amount.
    12. Any applicable fees or charges, such as Booking fees or Cancellation fees, will be clearly outlined at the time of Booking. Additional charges may apply for services requested beyond the scope of the original Booking.
    13. Everything Cruising takes the security of your Credit Card information seriously and have implemented industry standard security measures to protect your personal data. Your Credit Card details will be securely stored and processed in compliance with regulatory requirements.
    14. By providing your Credit Card information, you confirm that you are authorised to use the Card and that all information provided is accurate. You agree to pay for all charges incurred using your Credit Card.
    15. Electronic Funds Transfers are accepted subject to the bank receipt/transmission report being emailed to Everything Cruising.
    16. Credit will only be applicable on the date the funds are reflected in the Everything Cruising bank account.
    17. For urgent payments, your bank should be requested to make an immediate payment.
  4. Cancellation
    1. Everything Cruising reserves the right to cancel an itinerary before departure due to insufficient numbers or other unforeseen circumstances. In such an event, an alternative of equal or greater services will be provided. Should these options not be acceptable, Everything Cruising will refund the full price paid.
    2. If an Itinerary is cancelled by Everything Cruising due to unpredicted circumstances such as, but not restricted to, severe weather conditions or force majeure, Everything Cruising will refund all monies except any cancellation fees levied by airlines and other third parties.
    3. Unforeseeable circumstances such as force majeure, adverse weather, flight rescheduling, hotel overbooking and faults with transportation or road conditions may also influence the Itinerary after the commencement date. Any decision made in respect of services by the Supplier to re-route or amend the Itinerary due to any of the above or similar circumstances is at the discretion of the Supplier and Everything Cruising shall not be liable for any claim whatsoever arising from such events.
    4. Should any cancellations or changes arise at the discretion of the Supplier, cases are resolved in accordance with Supplier Terms and Conditions.
  5. Refunds
    1. All deposits are non-refundable/non-transferable.
    2. Refunds are subject to any additional charges or cancellation fees levied by the Supplier.
    3. Everything Cruising may levy a handling fee for bookings cancelled by the client, at a minimum charge of R1,500.00 plus VAT.
    4. For bookings in foreign currency, refunds are calculated as per the Rate of Exchange used at the time of payment.
    5. No refund will be considered for no-shows or any unused services irrespective of whether they form part of the basic package, or whether they are in respect of pre-booked optional arrangements. No refunds can be considered on partially unused hotel or cruise accommodations, flights, car rentals, or any other Services making up the Itinerary.
    6. Refunds can only be paid out by Everything Cruising once the funds have been received from the Supplier.
  6. Refusal of Carriage
    1. Everything Cruising and/or the relevant Supplier reserves the right to remove clients from services for reasons that impact the enjoyment or safety of other guests, such as, but not limited to, the physical, medical, or mental inability of the Customer to undertake the arrangements of the Itinerary, unsocial or unruly behaviour or the carriage of prohibitive substances and materials.
    2. In the event of the Customer being removed from services, neither Everything Cruising, nor the Supplier will refund any portion of unused services.
  7. Taxes and Surcharges
    1. Advertised prices will include Taxes and Surcharges. These charges will be quoted as a separate item as they are levied by third parties and are beyond our control.
    2. All packages that are inclusive of flights will be subject to airport taxes. Fuel levies charged by airlines and other transportation companies do fluctuate and are subject to change until your airline ticket or documents are issued.
    3. Some countries charge additional taxes and levies which may not be included in the price of your booking.
    4. All Taxes and Surcharges, included and not included in the package price, will be based on the applicable rate at the time of booking.
    5. Some Suppliers may impose special terms and conditions regarding Deposits, Payments, Cancellation fees and/or Refunds from time to time. All Bookings would be subject to these additional conditions.
    6. Please ensure that you have read and understand all Suppliers’ Terms and Conditions.
  8. Liability
    1. Everything Cruising acts as an intermediary of travel arrangements for waterborne transport, air transport, ground transport, rail, hotels, organised tours and wholesale tour operators, and other service providers.
    2. Everything Cruising does not own, manage, control, or operate any vehicle, any hotel or restaurant, or any other supplier of services.
    3. All air tickets, vouchers and confirmations issued shall constitute the sole contract between yourself and the Supplier.
    4. It is the passenger’s responsibility to reconfirm all flights at least 72 hours before departure and it is required that passengers must check well in advance that the check-in and/or departure times for all your flights, cruise passage, transfers, tours, and accommodation with a representative of Everything Cruising (as indicated on your vouchers) are correct. Failure to do so may result in the cancellation of the reservation.
    5. It is important to carefully check all information upon receipt and report any inaccuracies as soon as possible.
    6. Everything Cruising will not be responsible for any inaccuracies that are discovered after departure from South Africa.
    7. The responsibility to obtain correct, current, and valid passports, visas, vaccinations, inoculations, unabridged birth certificates, and re-entry permits required is solely that of the passenger. Passengers must ensure that they have all necessary documentation for themselves and their children in order before traveling.
    8. Everything Cruising will not be held responsible or liable for any consequence of any nature arising from the Customer failing to ensure that he/she has complied with all such requirements.
    9. All coupons, receipts and tickets are issued subject to the Terms and Conditions specified by the Supplier and all services are subject to laws of the country where the services are provided.
    10. Everything Cruising acts only as an agent for the Owners, Contractors and Suppliers of transportation and/or other related travel services provided and assumes no responsibility for the loss or damage to baggage or property or for any injury, illness or death or for any damages or claims howsoever caused arising directly or indirectly from accidents, loss or damage to person or property delays, transport, failure, strikes, wars and uprisings or acts of God etc. over which the Company has no control.
    11. Everything Cruising does not hold itself responsible for any delays before departure, nor during any services, whether brought about by technical difficulties, strikes, weather conditions, or any other circumstances whatsoever, whether foreseen or unforeseen. It is understood that any expenses relating to these unscheduled extensions (e.g. hotels, meals, airfares, telephone calls, etc.) will be for the passenger’s account. Passengers must refer to their respective travel insurance products purchased.
    12. Where the Customer uses the Services of a Travel Agent, it is the Travel Agent’s responsibility to ensure that all invoice, itinerary details, and documentation issued and made available by Everything Cruising are correct and that the Customer is aware of amendment and Cancellation conditions and other clauses in these Booking Conditions.
  9. Jurisdiction
    1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
    2. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
  10. Privacy
    1. Everything Cruising respects the privacy of its customers and will handle personal information under its Privacy Policy.
    2. The Customer explicitly consents to Everything Cruising processing information applicable to a specific natural or juristic person capable of identifying said natural or juristic person and includes, inter alia, age, gender, race, culture or religion, disability, identity number, marital status, physical address, contact details, correspondence and confidential documentation pertaining to a specific natural or juristic person “Personal Information”) for purposes of providing services to the Customer.
    3. If the Customer is providing certain Personal Information on behalf of a third party including, without limitation, minors, the Customer warrants that the relevant authority and/or permission to do so has been obtained.
    4. The Customer consents to Everything Cruising processing Personal Information to make travel arrangements as contemplated herein.
    5. Everything Cruising shall, always, ensure that the Customer’s Personal Information remains strictly confidential and that the Customer’s right to Personal Information being privileged shall not be prejudiced.
  11. Customer Care
    1. If the Customer is not entirely satisfied with the services offered by Everything Cruising and/or any of the services provided to the Customer by any of its Suppliers, please address the complaint in writing to Everything Cruising Customer Service Department at customercare@everythingcruising.co.za
    2. If the Customer is not satisfied with any aspect whilst in journey, they must inform a representative of the Supplier, Tour Guide, Cruise Ship Guest Relations, or Ground Operator immediately so that the issue can be addressed at the time.
    3. If resolution is not possible on the spot and the Customer wishes to lodge a complaint or claim, this must be done in writing to customercare@everythingcruising.co.za in South Africa within 7 days of the completion of the trip. It is imperative to attach relevant receipts, photographs, and substantiating evidence to the letter of claim.
  12. General Information
    1. This document, read together with Everything Cruising’s confirmation, invoice, itinerary, relevant Supplier’s standard terms and conditions, as applicable in the circumstances, constitutes the sole record of the agreement between the parties.
    2. No indulgence which Everything Cruising may grant to the Customer shall constitute a waiver of any of the rights of Everything Cruising, which shall thereby be precluded from exercising any rights against the Customer which may have arisen in the past or which might arise in the future.
    3. Everything Cruising cannot be held responsible for any charges that appear on a passenger’s credit card, nor accept responsibility for having any of these charges reversed or corrected upon the passengers’ return.
    4. Passengers choosing to hire a car internationally must ensure that they have a valid international driver’s license and a valid Credit Card to present to the car rental check-in counter.
    5. Hotel descriptions featured in our online posts are based on current hotel guides and contractual agreements provided by Suppliers. Any facilities described are subject to change at any time.
    6. Maps and photographs are included for general information only and may not necessarily reflect actual routings, locations, or services.
    7. Hotel room and Cruise cabin photographs may not be specific to the actual accommodatuion occupied.
    8. Passengers travelling solo may be subject to a single supplement in accordance with Supplier rules, unless the Supplier is able to match together “willing to share” passengers of the same gender. This offer is available on select products only.
    9. We recommend that you review information provided by the South African Department of International Relations and Cooperation (DIRCO) prior to making your booking by visiting their website www.dirco.gov.za for the latest information. We strongly recommend that you familiarise yourself with the latest Government Consular advice and information regarding the country you intend to visit.
    10. It is further advised that you register your details prior to departure on the Registration of South Africans Abroad website ROSA.gov.za.
    11. It is ultimately the passengers’ responsibility to ensure that they are in possession of valid passports with at least three blank pages next to each other, valid for at least 6 months after return date, as well as health documents and any visas that may be required.
    12. Travel Insurance is essential. Within 24 (twenty-four) hours of making a payment towards the travel arrangements, the Customer must ensure that they have purchased adequate travel insurance including, but not limited to, cover for cancellations due to a national disaster, pandemic such as the coronavirus, sickness, accident or injury, death in the family, as well as travel curtailment, baggage and sports equipment, medical emergencies etc. It is imperative that the Customer reads the policy wording to ensure he/she is fully aware of what is covered and what is excluded from the policy.
    13. Everything Cruising will not be held responsible or liable if the Customer fails to take adequate Insurance cover. Should the Insurers dispute their liability for any reason, the Customer will have recourse against the Insurers only.
    14. Passengers may be given a medical certificate at time of the Booking which must be completed by a medical practitioner and returned with their Booking Confirmation form if required by Supplier.
    15. Passengers may be required to submit a letter of fitness completed by their medical practitioner confirming they can undertake the demands of their itinerary unaided.
    16. All coupons, receipts and tickets are issued subject to the Terms and Conditions specified by the Supplier and all services are subject to laws of the country where the Services are provided.
    17. Everything Cruising acts only as an Agent for the Owners, Contractors and Suppliers of transportation and/or other related travel services provided and assumes no responsibility for the loss or damage to baggage or property or for any injury, illness or death or for any damages or claims howsoever caused arising directly or indirectly from accidents, loss or damage to person or property delays, transport, failure, strikes, wars and uprisings or acts of God etc. over which the Company has no control.
  13. Severability
    1. If any provision of these Terms and Conditions is found to be invalid or unenforceable, such provision shall be severed from the Terms and Conditions, and the remaining provisions shall remain in full force and effect.
  14. Entire Agreement
    1. These Terms and Conditions constitute the entire agreement between the Customer and Everything Cruising with respect to the provision of Services and supersede all prior agreements and understandings, whether written or oral.
  15. Acknowledgement of these Terms and Conditions

By processing a booking with Everything Cruising, we confirm that we have read and accepted the terms and conditions contained herein.
